General Terms and Conditions (GTC) Lenzerheide Sports Center

1. General
The General Terms and Conditions (GTC) apply to all services and products provided by the Lenzerheide Sports Center at its facilities.
This includes all facilities of the indoor pool, the entire wellness, fitness and ice hall area, the entire changing area, reception area as well as mini golf and all outdoor facilities.
Mit dem Betreten des Lenzerheide Sportzentrum wird die Geltung dieser AGB und aller bestehenden Regelungen anerkannt. Die AGB sind öffentlich einsehbar und können auf Verlangen schriftlich vorge-legt werden.By entering the Lenzerheide Sports Center, the validity of these GTC and all existing regulations is acknowledged. The GTC are available for public inspection and can be presented in writing upon request.

2. Contract
The contract with Lenzerheide Sport Center comes into effect with the purchase of a ticket/subscription, the redemption of a coupon/voucher or with the entry into the changing rooms for school classes, kindergarten groups and clubs etc.. From this point in time, the rights and obligations arising from the contract as well as the General Terms and Conditions become effective.

3. Prices and terms of payment
3.1. Admission prices indoor swimming pool, wellness, fitness and combination offers, ice hall and mini golf
The prices for the use of the facilities of the Lenzerheide Sports Center are published in the notices, in the Prospectus and on the Internet. All prices are (unless otherwise stated) per person or per item incl. statutory VAT in Swiss francs (CHF) and are binding. Single entries as well as 10er subscriptions are impersonal, single entries are only valid for the day on which they were redeemed. Season special, ¼ year, ½ year and annual season tickets are issued personally and are not transferable. For this purpose, personal data (first and last name, address, date of birth, telephone number) and a photo are deposited. Subscriptions of 10 can be used up over a period of 4 years. Refunds for unused subscriptions are not possible. An annual subscription is valid for 365 days from the date of signing the contract.

3.2. Prices rental facilities
Facilities (e.g. swimming lanes, ice) can be rented for a fee subject to availability and timely reservation. There is no right to rent.

3.3. Prices rental bath towels and swimming equipment, skates, hockey sticks, mi-nigolf clubs and balls.
The prices for rental of bath towels, swimming equipment, skates and hockey sticks are published in the notices and in the brochure in Swiss francs (CHF) and are per item. The rental of mini golf clubs and balls is included in the corresponding entrance fee.
An official identification document (e.g. identity card or driving license) must be deposited for the rented/leased items; in exceptional cases, a deposit must also be paid in cash, which must be settled in cash upon transfer of the rented item. The return/refund of the deposit is made with the return of the rented item.

3.4. Discounts and definition of categories of persons
Defined groups of people receive discounts on certain defined services/articles. These discounts are only granted upon presentation of corresponding valid identification. If an ID cannot be presented or is not valid, the next higher tariff group will be charged.

Adults from 17 years
Accompanying persons Persons with physical or mental disabilities who are dependent on an accompanying person must provide proof of this. The person with a restriction receives the group rate and the accompanying person can use the same facilities that the person to be accompanied uses free of charge.

3.5. Terms of payment
All tickets and season tickets are payable in cash or by card directly at the box office. It is also possible to purchase tickets via the online store. Payment by invoice is not possible.

3.6. Means of payment and foreign currencies
The Lenzerheide Sports Center accepts cash in Swiss francs and euros. The euro is converted 1:1. Change will be returned in Swiss francs. The following card payments are accepted: Maestro cards, V-Pay cards, Postcard, Master Card, Visa Card.

3.7. Prices and service changes
The Lenzerheide Sports Center reserves the right to change service descriptions and price information without prior notice until the conclusion of the contract in notices, on the Internet and brochures.

3.8. Cancellations and refunds
Cancellations of purchased single tickets, 10-ticket subscriptions, season and ¼-year subscriptions, ½-year subscriptions and annual subscriptions are generally not possible. Refunds of unused tickets are not possible.
Cancellations for reserved ice rinks or swimming pools are free of charge up to 7 days before arrival. After that 50% of the rental price will be charged.

4. Tickets
4.1. Single tickets
The purchase of a single admission (indoor swimming pool, wellness, fitness, combined admissions, ice rink and mini golf) entitles the holder to use the corresponding area once.

4.2. 10-ticket subscriptions
10 subscriptions can be purchased for the use of the indoor swimming pool, the wellness facility, the fitness facility, the ice rink or the mini golf. These are non-personal and transferable and entitle the holder to visit the booked category 10 times in a period of 4 years from the date of purchase.
4.3. Season special, ¼ year, ½ year and annual subscriptions
Season special, ¼ year, ½ year and annual season tickets entitle the holder to admission in the booked category for the duration purchased. Season special, ¼ year, ½ year and annual season tickets are personal and cannot be transferred.

4.4. Ticket abuse
If a ticket misuse, e.g. use by third parties, forgery, unauthorized passing on, is detected, a single admission combined (indoor pool, wellness, fitness, ice cream or mini golf) will be charged in addition to processing fees in the amount of CHF 55.00. Falsified data carriers will be confiscated immediately. The Lenzerheide Sports Center reserves the right to take legal action.

5. Misconduct of guests
If the present regulations are violated or instructions from employees of the Lenzerheide Sports Center are disregarded, the guest may be temporarily or permanently excluded from the use of the facilities. The ticket will be confiscated without compensation. The right to file a criminal complaint remains reserved.
Anyone who endangers themselves and other guests of the Lenzerheide Sport Center as a result of drunkenness or drug abuse will be temporarily or permanently expelled from the facility. A ticket refund is excluded in this case.
Anyone who damages or soils the facilities and equipment of the Lenzerheide Sports Center must pay the repair and cleaning costs in full. Should damage or soiling occur wantonly, the Lenzerheide Sports Center reserves the right to file a criminal complaint.

6. Operational restrictions and force majeure
The Lenzerheide Sports Center is not liable for interruptions of service due to force majeure. The season ticket holder is entitled to a credit note for service interruptions that are carried out in the course of overhauls, provided that the overhaul lasts longer than 3 weeks. The credit will be made to the extent of the period that exceeds 3 weeks.

7. Liability
The Lenzerheide Sports Center is liable for personal injury and property damage caused by it or its employees in accordance with the following provisions. Subsidiarily, the relevant provisions of the Swiss Code of Obligations apply. Liability is limited, as far as legally permissible, to gross negligence and wilful misconduct. Liability on the part of Lenzerheide Sport Center for damage to property and personal injury is specifically excluded in the case of:
- Non-compliance with instructions
- Disregard of instructions and warnings of the Lenzerheide Sport Center employees
- Negligent behavior or intentional disregard of regulations on jumping and sliding areas.
- running in the whole indoor swimming pool and wellness area
Lenzerheide Sportzentrum is liable for personal injury or property damage resulting from the non-fulfillment or improper fulfillment of the contract within the scope of these GTC and the applicable national laws. Any liability for theft, damage to property or personal injury by third parties is excluded.

8. Insurance
The conclusion of an accident and health insurance is recommended.

9. Customer data
The Lenzerheide Sports Center undertakes to comply with the applicable data protection legislation in the handling and processing of all customer data and customer usage data. Customer data will only be used to maintain and improve customer relations, quality and service benchmarks, to maximize operational safety or in the interest of sales promotion, product design, crime prevention, accident investigation, key economic data and statistics, and invoicing. The customer hereby acknowledges and agrees that in cases of joint provision of services in cooperation with third parties, the Lenzerheide Sports Center is entitled to make customer data available to the third parties concerned to the extent that this is necessary in the interest of providing the service. The disclosure of customer data to third parties is only permitted with the express consent of the customer. The only exception to this is if Lenzerheide Sportzentrum is legally obliged to pass on personal data. (for example Corona).

10. Video surveillance
To ensure the safety of Lenzerheide Sport Center guests, the facility is under video surveillance. Excluded from this are the saunas and changing rooms. The data is stored temporarily and access is only very restrictive and is used in particular to clarify accidents and crimes.

11. Applicable law and place of jurisdiction
Notifications by email are deemed to have been sent in writing. Swiss law is exclusively applicable to the legal relationship between the customer and Lenzerheide Sportzentrum.
If a provision of the contract or the content of a provision of these GTC or another supplement to the contract is or becomes invalid, this shall not affect the validity of the remainder of the contract. The contracting parties shall replace the invalid provision by a valid provision which comes as close as possible to the intended economic purpose of the invalid provision as well as to the originally agreed contractual balance.

The exclusive place of jurisdiction for any disputes arising from this contract is Lenzerheide.
